Neil Mody Discusses Legal
Developments Impacting the Total Pollution Exclusion and
Other Critical Concepts of Insurance Coverage Law

Neil V. Mody
presented on recent judicial interpretations of key
insurance coverage provisions to senior claim
executives, in-house and outside counsel, and insurance
claim professionals at the 2010 Western
Regional Adjusters Conference hosted by the Property
Loss Research Bureau and Liability Insurance Research
Bureau on November 1-3
in Anaheim, California. The program included a concise
synopsis of legal opinions and legislative findings
issued nationwide on the total pollution exclusion,
absolute pollution exclusion, and similar exclusions for
claims arising from the "discharge, dispersal, seepage,
migration, release or escape" of pollutants in various
factual contexts. The interactive seminars featured
vibrant discussions among participants while considering
hypothetical hazardous substance exposure claims modeled
after actual cases under several states' emerging
laws.
Mody is a
member of Connell Foley's Insurance Coverage Practice Group.
His legal practice is focused on litigation, counseling and
monitoring on behalf of domestic and internationally-based
insurers with respect to a broad range of insurance coverage
matters dealing with first-party property
claims, general liability coverage, excess claims,
long-tail claims (such as environmental, asbestos and other
toxic torts), bad faith/extra-contractual claims,
reinsurance matters, professional liability, product
liability and catastrophic loss. Mody is an active
participant in several insurance coverage law societies,
including PLRB/LIRB, an insurance trade organization whose
purposes include promoting education with respect to new
developments in liability and property issues within
the insurance industry.
